Administrative Law
Experienced administrative law attorney for objection, appeal, and urgent matters
Welcome to Farber Zwaanswijk Advocaten. Do you have a dispute with an administrative body, such as the municipality, the UWV, Justis, or a regulatory authority? If so, it is important to act quickly and carefully. We assist you with objection, appeal, and urgent procedures, and safeguard your deadlines and legal position.
Do you have an administrative law dispute?
When you have a dispute with the government, it is important that you are familiar with administrative (procedural) law and especially with the strict deadlines. Farber Zwaanswijk Advocaten has extensive experience with procedures against administrative bodies and can submit a statement of views, a notice of objection, or a notice of appeal on your behalf. We also assess whether you can invoke (written or unwritten) principles of proper administration.
Sometimes a decision on an objection or appeal cannot be awaited because there is an urgent interest. In that case, we can request a preliminary injunction from the preliminary relief judge, for example, to suspend a decision.
Our specializations within administrative law
Administrative appeal
For some decisions, an administrative appeal to a higher administrative authority applies. We examine whether this is applicable and ensure a strong substantiation.
Appeal procedure
Is your objection being rejected? Then an appeal to the administrative court may be possible. We carefully substantiate your case and assist you throughout the proceedings.
Administrative fine
An administrative fine can have major financial consequences. We assess the basis for the fine, proportionality, and procedural errors. We provide a defense where necessary.
Objection procedure
Do you disagree with a government decision? In many cases, an objection is the first step. We assess the decision, draft the objection, and monitor the deadlines.
Higher appeal
In certain cases, an appeal against a court ruling may be open. We assess the chances and conduct the proceedings on your behalf before the highest administrative court.
Order subject to administrative enforcement
An order subject to a penalty for non-compliance obliges you to rectify a situation, under penalty of a sum of money. We assess the lawfulness and can lodge an objection or appeal.
A statement of opinion is your response during a phase in which the administrative body has not yet made a final decision. It is often a crucial moment to submit facts and arguments in a timely manner.
If there is a matter of urgency and you cannot await the outcome of an objection or appeal, a preliminary injunction may be requested to (temporarily) suspend the decision.
An objection is the first step taken with the administrative body itself. An appeal is the subsequent step taken with the administrative court if the objection is rejected.
Deadlines are often short. Do not wait; have the decision reviewed immediately.
Preventive action
Do you anticipate that an administrative body is going to take a decision that you do not agree with? Then it may be wise to involve an administrative law attorney at an early stage. Frequently, before a decision becomes final, agreements can be made in consultation with the administrative body or a file can be supplemented in a timely manner.
Procedures against administrative bodies are often extensive and impactful. We can assist you with, among other things:
- submitting a statement of views;
- submitting a notice of objection;
- lodging an administrative appeal (where applicable);
- lodging an appeal with the administrative court;
- requesting a preliminary injunction;
- lodging a further appeal.
